Children of families going through separation or divorce are within the jurisdiction of the Family Law Act. The law regarding who children can spend time with, when and how is based around what is best for the child. The law requires significant consideration of the issues that affect the child/children before making any order. The law also has consideration of those children that are potentially within immediate harm.
Without the right advice, the legal considerations and arrangements for children can be complex. We strongly believe in getting these arrangements agreed to without the need of attending court. This is done through Consent Orders or Parenting Plans.
If you’re unsure on what applies to you please contact us and we’ll happily explain the right approach for your situation and the children.
